大川原化工機えん罪事件 捜査員2人“不起訴は不当”検察審査会
横浜市の化学機械メーカー「大川原化工機」をめぐるえん罪事件で、捜査に不利になる実験データを除いた報告書を作成した疑いで刑事告発され、不起訴になった警視庁公安部の当時の捜査員2人について、検察審査会は、不起訴は不当だと議決しました。検察が改めて起訴するかどうか判断することになります。
「大川原化工機」の社長など3人が不正輸出の疑いで逮捕・起訴されたえん罪事件で、警視庁公安部の当時の捜査員2人は、捜査に不利になる機械の温度測定の実験データを除いた報告書を作成した疑いで刑事告発されましたが、東京地方検察庁はことし1月、いずれも嫌疑不十分で不起訴にしました。
メーカー側の申し立てを受けて東京第6検察審査会は、26日までに捜査員2人の不起訴は不当だと議決しました。
その理由として「実験したものの、立件するには温度が不十分な結果だったために、経済産業省に報告する書類から除いたといわざるをえない。すべての結果を経済産業省に示して判断を仰ぐべきで『立件ありき』で捜査し、実験結果を記載しなかったのは許されない」としました。
そのうえで「検察の嫌疑不十分という判断は受け入れられない」としています。
この議決を受け、東京地検が再捜査を行い、改めて起訴するかどうか判断することになります。
