「日本版DBS」うその申告で内定取り消しなどガイドライン素案
教育や保育など子どもに接する仕事に就く人の性犯罪歴の有無を確認する「日本版DBS」の運用について、採用の際に、性犯罪歴について本人がうその申告をした場合、「重大な経歴詐称」に該当するとして内定の取り消しができるなどとするガイドラインの素案が示されました。
来年12月に運用開始予定の「日本版DBS」は、子どもへの性犯罪を防ぐため、学校や保育所などで子どもと接する仕事に就く人に性犯罪歴がないかなどを確認する制度です。
制度運用のガイドラインを策定するための検討会が30日開かれ、こども家庭庁は、性犯罪の前科がある人への対応など、ガイドラインの素案を示しました。
それによりますと、新規に採用する際、事業者には募集要項の採用条件に性犯罪の前科がないことを明示し、面接や誓約書などを通して、性犯罪歴の有無を確認することを求めています。
その上で、本人が性犯罪の前科がないと申告したのに、その後に犯罪歴があったことが分かった場合は、「重大な経歴詐称」に該当するとして、内定の取り消しができるとしています。
一方で、性犯罪歴の有無を事前に確認していない場合は、犯罪歴のみをもって直ちに内定を取り消すことは難しいとしています。
こども家庭庁は、事業者や子どもへの聞き取りを行うなどして、年内にガイドラインをまとめる方針です。
